美國ITC正式對外國製造的半導體器件及其下遊產品和組件啟動337調查

2025年3月21日，美國國際貿易委員會(hui) （ITC）投票決(jue) 定對特定外國製造的半導體(ti) 器件及其下遊產(chan) 品和組件（Certain Foreign-Fabricated Semiconductor Devices, Products Containing the Same, and Components Thereof）啟動337調查（調查編碼：337-TA-1443）。

2025年2月18日，愛爾蘭(lan) Longitude Licensing Ltd. of Ireland、愛爾蘭(lan) Marlin Semiconductor Limited of Ireland向美國ITC提出337立案調查申請，主張對美出口、在美進口和在美銷售的該產(chan) 品違反了美國337條款（侵權美國注冊(ce) 專(zhuan) 利號7,745,847、9,093,473、9,147,747、9,184,292），請求美國ITC發布有限排除令、禁止令。

中國台灣地區Taiwan Semiconductor Manufacturing Company Limited of Taiwan、美國Apple Inc. of Cupertino, CA、美國Broadcom Inc. of Palo Alto, CA、中國香港特別行政區Lenovo Group Limited of China、中國湖北Motorola (Wuhan) Mobility Technologies Communication Company Limited of China摩托羅拉（武漢）移動技術通信有限公司、中國福建Motorola mobiles Communication Technology Ltd. of China摩托羅拉移動通信技術有限公司、中國廣東(dong) OnePlus Technology (Shenzhen) Co., Ltd. of China、美國Qualcomm Inc. of San Diego, CA為(wei) 列名被告。

美國國際貿易委員會(hui) 將於(yu) 立案後45天內(nei) 確定調查結束期。除美國貿易代表基於(yu) 政策原因否決(jue) 的情況外，美國國際貿易委員會(hui) 在337案件中發布的救濟令自發布之日生效並於(yu) 發布之日後的第60日起具有終局效力。
